Privacy Policy (“Privacy Policy”) of GuocoLand (Malaysia) Berhad (“GLM”)

1. This Privacy Notice is applicable and being provided to a natural person (existing and prospective) who is a customer, homebuyer, employee, contract staff, stakeholder, director, shareholder, sole trader, natural persons constituting a partnership and third parties (“Relevant Persons”) who have dealings, connections and/ or engagement with GLM and its related companies, which include its holding companies, subsidiaries, and associate companies (collectively referred to herein as “GLM”) from whom personal data have been and/or may in the future be collected.
2. GLM may process the personal data of a Relevant Person, including but not limited to collect, use, disclose, retain, dispose and protect such personal data in accordance with the Personal Data Protection Act 2010 (“PDPA”) and other applicable laws and regulations of Malaysia.
3. GLM may obtain personal data of the Relevant Persons from its dealings, connections, and/ or engagements with the Relevant Persons, and from such other sources and from any of the companies within Hong Leong Company (Malaysia) Berhad and its subsidiaries (“Hong Leong Group”) whereby the Relevant Persons have given consent to the processing of the personal data relating to them to the extent permitted by PDPA.
4. The personal data that may be collected from a Relevant Person include but is not limited to his/her name, NRIC number/passport number (for foreigners), address, email address, telephone number, employer’s details, his/her credit card information and bank account details, financial position, family members, and images originating from CCTV recordings captured during the Relevant Person’s visit to any outlet, office or branch of GLM. In respect of a Relevant Person who is a job applicant this may include his/ her qualifications, employment history, knowledge, experience, expertise and sensitive personal data (medical record) of such job applicant.
5. Relevant Persons are obliged to provide personal data that are identified as mandatory or necessary for the performance of contract or perfection of a contemplated transaction. In respect of personal data identified as optional, the provision of such personal data by a Relevant Person is voluntary. If a Relevant Person does not supply the personal data identified as mandatory, this may result in GLM being unable to provide products/ services or otherwise deal with that Relevant Person.
6. If the Relevant Person provides personal data of any third party to GLM, the Relevant Person represents and warrants that he/ she has obtained the necessary consent from that third party to share and transfer his/ her personal data to GLM, and for GLM to collect, use and disclose that personal data in accordance with this Privacy Notice.
7. A Relevant Person’s personal data may be used or processed by GLM or on its behalf for the following purposes:-
   1. carrying out its instructions, providing products and/or services (whether by GLM or a member of the Hong Leong Group or a selected third party), evaluating and assessing suitability for employment (where relevant), and responding to enquiries by that Relevant Person or made on its behalf;
   2. maintaining records of its instructions and/or orders received, including managing and preparing reports on any incidents and/or accidents;
   3. managing the administrative and business operations of GLM and complying with internal policies and procedures;
   4. creating, administering and updating that Relevant Person's account on any GLM's application and/or platform;
   5. performing internal operations necessary to provide any GLM's application and/or platform, including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analysing usage and activity trends;
   6. protecting the security or integrity of any GLM's application and/or platform and any facilities or equipment used to make such application and/or platform available;
   7. researching, designing, launching, promoting and marketing financial and other facilities, services and products of GLM and the Hong Leong Group and third parties (including but not limited to the exchange of non-financial information with selected business partners and developing marketing lists for exchange with selected business partners), and monitoring the provision, operation, and use of such services or products;
   8. provision of reference (status enquiries);
   9. verification of identity
   10. carrying out credit and other status checks and debt collection and assisting other institutions to do so;
   11. assessing ongoing credit-worthiness of a Relevant Person;
   12. operating internal controls including determining amounts owed to or by Relevant Persons, payment to or collection of such amounts from Relevant Persons and from any persons providing security for Relevant Persons’ obligations, and enforcing any charge or other security granted by or for Relevant Persons;
   13. for audit, compliance and risk management purposes;
   14. the enforcement of Relevant Persons’ obligations, including without limitation the collection of amounts outstanding from Relevant Persons and those providing security for Relevant Persons’ obligations;
   15. assessing and analysing any insurance claim and assisting other insurance companies to conduct claims checks;
   16. forwarding publicity materials or other information to Relevant Persons from GLM or a member of the Hong Leong Group or charitable organizations from time to time;
   17. meeting any legal, governmental, or regulatory requirements in Malaysia or any other applicable jurisdiction, including disclosure or notification or record retention requirements;
   18. assisting any person who is acquiring or participating in any contractual arrangements between GLM and the Relevant Person to evaluate the transaction for such acquisition or participation;
   19. human resource applications;
   20. to enable a party to evaluate any actual or proposed assignment, participation, sub-participation and/ or novation of GLM’s rights and/or obligation;
   21. for any actual or proposed merger, sale or transfer of any part of GLM’s interest, assets, obligations, business and/or operations;
   22. for the purposes of preventing, investigating, reporting or otherwise in relation to actual or suspected money laundering, terrorist financing, bribery corruption, actual or suspected fraud including but not limited to fraud, tax evasion, evasion of economic or trade sanctions, and criminal activities generally or other unlawful activities;
   23. for the products/ services enhancement and improvement, as well as quality assurance, training and security purposes;
   24. to allow GLM or any member of the Hong Leong Group and their respective service provider and business partner to promote their product and/ or services;
   25. to administer GLM or any member of the Hong Leong Group’s events, competitions and promotions;
   26. for the purpose of data processing and analytics, including but not limited to data mining and analysis of the Relevant Person’s transaction with GLM;
   and any other incidental and associated purposes relating to any of the above.
8. Personal data held relating to a Relevant Person will be kept confidential but it may be provided to:
   1. any person under a duty of confidentiality to GLM or to a member of the Hong Leong Group;
   2. any company or division within GLM or the Hong Leong Group (whether such company or division operates in Malaysia or elsewhere);
   3. any relevant agent, contractor, or third party service provider who provides administrative, telecommunications, data processing and storage, computer, payment, securities clearing, management, audit, insurance, professional, or other services to GLM or the Hong Leong Group;
   4. any banking, financial, or other institution with which the Relevant Person has or proposes to have dealings, connections, and/ or engagements with GLM;
   5. any credit reference agency and in default debt collection agencies or similar provider of debt collection or credit information services to GLM or the Hong Leong Group;
   6. lawyers, auditors, tax advisors, investment banks, and other professional advisors;
   7. any insurance company and any association or federation of insurance companies (whether or not based in Malaysia);
   8. any person or corporation to whom GLM or a member of the Hong Leong Group transfers or proposes to transfer its interests and/or obligations in respect of that Relevant Person or any product or service provided to that Relevant Person;
   9. any person or corporation to whom GLM merges, sells, or transfers or proposes to merge, sell or transfer any part of its interests, assets, obligations, businesses and/ or operations;
   10. the general public when the Relevant Person becomes a winner in a contest, when he/ she is a participant in any GLM or any member of the Hong Leong Group’s events, conferences, talks and seminars, by publishing the Relevant Person’s name, photographer and other personal data without compensation for advertising and publicity purposes;
   11. any nominee, trustee, co-trustee, centralised securities depository or registrar, custodian, insurance company, estate agent, solicitor, or other person who is involved with the provision of services or products by GLM or a member of the Hong Leong Group to that Relevant Person; or
   12. any person by whom GLM or a member of the Hong Leong Group is required by applicable legal, governmental or regulatory requirements to make disclosure;
   or to any other person reasonably requiring the same in order for GLM to carry out the purposes permitted in paragraph 7 above.
9. GLM may disclose personal data to any or all of the parties stated above and may do so notwithstanding the recipient’s place of business is outside Malaysia, or that such information following disclosure will be collected, held, processed, or used by such recipient in whole or in part outside Malaysia.
10. A Relevant Person is entitled to ask whether GLM holds personal data on them and to request access to and the correction of any such personal data held. A reasonable fee will be charged for processing each data access request.
11. Requests by a Relevant Person for access to or correction of personal data held by GLM or for withdrawal of consent for GLM to process the Relevant Person’s Data, should be addressed to the Data Protection Officer (“DPO”), GuocoLand (Malaysia) Bhd, Level 13 Guoco Tower, Damansara City, No. 6 Jalan Damanlela, Bukit Damansara, 50490 Kuala Lumpur (Tel: 03-2726 1000). Note that withdrawal of consent or failure to provide requested personal data will result in GLM being unable to process the Relevant Person’s application, request or complaint, provide our products or services, engage services of the Relevant Person, enter into business, contractual or employment relationships or arrangements with the Relevant Person or otherwise deal with that Relevant Person.
12. If Relevant Persons do not want to receive any marketing or follow up regarding products and special promotions from GLM or the Hong Leong Group, please notify the DPO in writing.
13. To help GLM to provide a better service to you, please ensure that your personal data such as contact details including your home and office addresses, your telephone numbers (including your mobile telephone number), e-mail address, and other details that you have provided/ registered with us are up to date.
14. The provisions of this Privacy Notice are found in GLM’s website and does not apply to third party websites that you have access from GLM’s websites. To determine how such third party websites deal with the Relevant Person’s data, the Relevant Person should ensure that he/ she reads their respective privacy notices.
15. The provisions of this Privacy Policy will form part of the account terms and conditions and/or the agreement or arrangements that you have or may enter into with GLM. If any inconsistency is found, the provision of this Privacy Policy shall prevail.

Changes to this Privacy Policy

Changes may from time to time be made to this Privacy Policy. We will post notice of material changes on GLM’s website. Please re-visit this Privacy Policy from time to time to learn of any such changes.
